Records: grandfather makes first appearance in granddaughter's death

TOPEKA, Kan. (WIBW) -- A 4-year-old girl who died at a Silver Lake home on July 23 is a granddaughter of the man charged with murder in her death, according to records examined Friday.

The defendant, Timothy W. Funk Sr., 56, is charged with felony first-degree murder and two felony counts of aggravated endangering a child, according to court records.

Timothy Funk made his first appearance on Friday in Shawnee County District Court.

On July 23, Shawnee County sheriff's deputies found Brandy Lee Funk unresponsive at a home in the 300 block of S. Masche Street in Silver Lake. Medical crews pronounced the child dead at the scene.

On Friday, Timothy Funk remained in Shawnee County Jail in lieu of a $500,000 cash or surety bond, court records said.

During his first appearance, Funk told Shawnee County District Court Judge Jason Geier that he intends to hire an attorney to defend him. However, Geier told Funk that the defendant can ask the court to appoint an attorney to represent Funk.

The murder and aggravated endangering charges were filed on Tuesday afternoon in a complaint, according to the document's file stamp.

But attempts to view the complaint on the district court web site and to get a copy of the complaint weren't successful until Friday afternoon.

The murder charge alleged Funk killed the child "in the commission of, attempt to commit, or flight from any inherently dangerous felony." The murder and child endangering charges occurred on July 23, court records said.

The district court charges didn't specify what the endangering activities were.

Aggravated endangering a child is defined as unlawfully, feloniously, and recklessly causing or permitting a child younger than 18 to be placed in a situation in which the child's life, body or health is endangered.

In one charge of aggravated endangering a child, the slaying victim was identified as "B.F." with a year of birth of 2014.

Obituary records list Brandy Lee Funk's date of birth as October 31, 2014, and her age as 4.

Of Brandy Funk's three surviving grandparents, one is Timothy Funk.

Funk is to next appear in court on November 14 before District Court Judge David Debenham.
