OSHA will not investigate death at Heartland Motorsports Park

TOPEKA (WIBW)--- The Occupational Safety and Health Administration 13 NEWS, it will not investigate the explosion at Heartland Motorsports Park that claimed a man's life.

Joshua Auburt, 41 died May 7th. Topeka Fire officials say he was using a torch to cut open what was believed to be an empty metal drum labeled 'methonal' and it exploded.

Heartland Park was hosting the NHRA Heartland Nationals event at the time.

OSHA told 13 NEWS Auburt was a self-employed contractor, and they have no jurisdiction in that area.

They say they deal with employee/employer situation, so they may only conduct investigations when an employee of a company is injured.

A memorial service for Auburt will be held at 2:00 p.m., Saturday at Crestview Park. Auburt leaves behind a wife and five children.
