Jurors return guilty verdict in fatal shooting

TOPEKA, Kan. (WIBW) - Jurors returned a guilty verdict Friday in a 2018 fatal shooting.

Tony Lee Foster, 33, was convicted of second degree murder, and criminal possession of firearm. The decision followed five days of testimony.

The charges stemmed from the July 9, 2018 shooting of David Payne, 35, at 916 NE Madison. During the trial, Foster's live-in girlfriend testified that Foster was trying to unload a handgun when it went off. A single shot hit Payne.

Witnesses were helping Payne when officers arrived, but Foster had already fled. He was arrested the next day.

A sentencing date is not yet set.
