The Topeka Police Department says it's cracking down on a so called "loop-hole" found in the Topeka smoking ban.
The owner of Hot pockets bar and Hot pockets retail cigarette shop says it it legal to separate his businesses with duct tape. Smoking is allowed in retail tobacco stores, but not in bars. His building houses his bar and a smoke shop separated only by duct tape on the floor. The Topeka Police Department released a statement today stating that bars like Hot pockets are not allowed to use duct tape to allow smoking in certain areas of their bar. While there is an exception in the ordinance for retail tobacco stores, allowing smoking in bars will not be tolerated. TPD says it will notify those who are violating the smoking ban that went into effect on December 4th, and take action if necessary.

Sadly in America a business owner does not get to chose if his customer can smoke. I'm more worried about laws that can take away rights and freedoms because it is for the good of all. How about everyone who is on state assistance gets "fixed" because that would be for the good of everyone too! Wait is that a little too communist for you right now? Keep this up and you'll see it in 20 years.
To the Anonymous post. Maybe you should read the law cause it's all there in black and white what they are doing is legal one of the officers that came to bar said so himself. So before you accuse this guy of thumbing his nose at the ban READ the law cause he is just standing up for his rights as we all should.
If Hot Pockets wants to run two businesses from the same address that's "their business". But they should have to erect floor-to-ceiling walls so that the smoke from the tobacco business is kept away from the bar business.
