KS Supreme Ct. Weighs Child Sex Offender's Probation
Spencer could have gotten a life sentence in June 2008, after pleading guilty to sexual charges involving a 6 year old and 7 year old, but then District Court Judge Matthew Dowd gave the then 75 year old 3 years probation.

TOPEKA, Kan. (WIBW)_ The Kansas Supreme Court is hearing a Shawnee County District Court appeal of a sentence for convicted child sex offender Harold Dean Spencer.

Spencer could have gotten a life sentence in June 2008, after pleading guilty to sexual charges involving a 6 year old and 7 year old, but then District Court Judge Matthew Dowd gave the then 75 year old 3 years probation.

Dowd’s decision came just 4 days before Jessica’s Law went into effect. That law restricts any downward departures from sentencing guidelines on child sex offenses.

The state argues Dowd abused his discretion in giving Spencer probation.
