A Topeka developer's lawsuit against the city could face delays.

A pretrial hearing was held in the case Wednesday. Gene Jani is suing over the City Council denying a zoning change for a proposed development at 34th and Fairlawn.

In court Wednesday the judge granted the city an additional ten days to respond to an amended motion from Jani's attorney. Both sides also have two weeks to exchange information and there'll be a hearing to determine information councilman john alcala will have to turn over to the court.

A trial is set for September second Jani told 13 News Wednesday he's ready to move forward but it's unclear whether the city will ask for more time.
