Edwin Hall is accused of killing 18 year old Kelsey Smith after kidnapping her in Overland Park June second.
The defense wants prosecutors to hand over data showing how DNA was tested in the case.
They'll have a defense expert analyze the data.
Prosecutors says they'll provide an electronic copy of the DNA analyzed by the lab but it will be in a read-only format.
A hearing on the case is scheduled for Wednesday.
The state is seeking the death penalty.
