Court Dates Set for Alleged Triggerman in Jeweler's Murder

The second man charged in the murder of a retired Topeka jeweler will face charges of first-degree murder and aggravated battery, first man pleaded guilty in February.

LAWRENCE, Kan. (AP) _ A second man charged in the killing two years ago of retired Topeka jeweler Clarence Boose is due in court May 25th for a preliminary hearing.

Thirty-five-year-old Allen Dale Smith is charged with first-degree murder and aggravated burglary. If Smith is bound over on the charges, his trial will start September 24th.

Smith's cousin Leonard Wayne ``Battle Ax'' Price pleaded guilty in February to felony murder in Boose's slaying and is scheduled to be sentenced May 18th. During Price's preliminary hearing last fall, a detective testified that Price told him Smith shot Boose as the two burglarized his home.

The 77-year-old Boose was shot to death in his home near Lecompton. Boose was the former owner and operator of David's Jewelers in Topeka.
