An appeals court has overturned overturned child molestation convictions against an Americus man.
Kenneth Waddell was found guilty in late 2003 of rape, aggravated sodomy and aggravated indecent liberties with a child after a seven-year-old girl accused him of molesting her.
The Kansas Court of Appeals said this week that the girl's videotaped statements during the trial violated Waddell's constitutional rights. The court also said the judge shouldn't have allowed testimony from Waddell's daughter.
Lyon County Attorney Marc Goodman says he'll ask the Kansas Supreme Court review the ruling.
