Judge grants defense an eight-month delay in the third trial for former Westar CEO David Wittig and former strategy officer Douglas Lake

TOPEKA, Kan. (AP) _ A federal judge has pushed back the third
trial for two former Westar Energy executives accused of conspiring
to rip off the utility.
Judge Julie Robinson Monday scheduled the trial to begin September 9th of next year instead of the original date of January 14th.
Former Westar CEO David Wittig and former strategy officer Douglas Lake face charges of conspiracy and circumventing internal controls at Westar.
Their first trial ended in a mistrial in 2004 while a jury convicted them in 2005 of wire fraud and money laundering. An appeals court last January overturned that verdict and said those charges could not be brought back for trial.
Lake's new attorney asked a yearlong delay for the third trial.
Robinson said an eight-month delay was more reasonable, overruling prosecutors' complaints that a delay wasn't necessary.
