Convicted Child Molester's Convictions Thrown Out
Americus man had the guilty verdict against him overturned since he was never given a chance to confront his accuser.

TOPEKA, Kan. (AP) _ An Americus man will get a new trial after the Kansas Supreme Court this week threw out his 2005 child molestation convictions.

Kenneth Waddell was found guilty in late 2003 of rape, aggravated sodomy and aggravated indecent liberties with a child after a seven-year-old girl accused him of molesting her.

Last year, the Kansas Court of Appeals overturned the convictions. The court said the girl's videotaped statements during the trial violated Waddell's constitutional rights to confront his accuser.

Lyon County Attorney Marc Goodman appealed the case to the Supreme Court, which essentially support the appeals court by throwing out the convictions on the same grounds.

Goodman says he's disappointed but will retry Waddell as soon as possible.

what kind of man is he wanting to question a littler girl, he put fear into her then and now he just wants to control her again, by hopeing that she will recant her statment.
