Judge in Kelsey Smith Case Denies Jurisdiction Change Request
Lawyers for the man charged with capital murder in the death of an 18-year-old woman argued today that the case should be dismissed from Kansas because the woman's body was found in Missouri.

OLATHE, Kan. (AP) _ Lawyers for the man charged with capital
murder in the death of an 18-year-old woman argued today that the
case should be dismissed from Kansas because the woman's body was found in Missouri.

Defense lawyer Paul Cramm also asked Johnson County District
Judge Peter Ruddick to dismiss the case against Edwin Hall because
the grand jury that indicted Hall was improperly called.

Hall is accused of abducting Kelsey Smith from a Target parking
lot in Overland Park in June. Her body was found four days later in
a park about 20 miles away in Missouri. He's charged with capital
murder, rape, kidnapping and sodomy.

Ruddick denied the request to dismiss the case because of
jurisdiction, but says he'll rule later on the motion to dismiss
because of the manner in which the grand jury was called.
