Weir Death Lawsuit Pushed Back

TOPEKA, Kan. (WIBW) - A drowning trial involving the state of Kansas and the city of Topeka has been postponed.

Jim Bryant filed the lawsuit in 2009 after his son and another man died in 2007 when their canoe capsized going over a spillway at the end of a low water weir on the Kansas River in Topeka.

The lawsuit states authorities failed to warn boaters of the danger of the weir, provide a route to avoid the weir and comply with putting a boat ramp upstream from the weir.

The trial was set to begin on March 5th but has been rescheduled for the 12th.
