TOPEKA, Kan. (WIBW) - A Shawnee County judge denied two motions Wednesday filed by a Topeka man facing a new trial on murder charges.
The Kansas Supreme Court overturned James Qualls conviction for second degree murder in the 2008 death of Joseph Beier at a Topeka bar. His retrial is set for October 28th.
The Kansas Supreme Court agreed with Qualls' appeal that jurors should have been instructed on the lesser charge of voluntary manslaughter.
Another motions hearing is set for October 16th, where Qualls will ask to suppress some evidence dealing with security camera video recorded during the murder.
