Reporter's Courtroom Photo Leads To Mistrial In Murder Case

TOPEKA, Kan. (WIBW)-- A Topeka murder trial has ended in mistrial after a reporter apparently posted a photo online from the court room using Twitter.

The felony-first-degree murder case is against Austin Tabor. He's one of four people charged in the death of Matthew Mitchell outside Topeka West High School.

CJOnline.com is reporting it was a Topeka Capital-Journal Reporter that posted a photo online using the social networking site Twitter. The photo showed one or more of the jurors.

Topeka Capital-Journal Publisher Gregg Ireland said the photo contained the profile of a juror in the background and was inadvertently posted. Ireland says the Capital-Journal regrets the error and loss of the court's time.

The paper reports prosecutors will try to schedule a new trial for this summer.
