TOPEKA, Kan. (WIBW) - The man sentenced last week for the break-in and assault at WIBW-TV last year will appeal his sentence.
Ray Miles must serve nearly 8.5 years for the May 23, 2012 break-in.
Wednesday, he was ordered to pay more than $5,000 restitution to WIBW and the company's workers compensation insurance company.
Miles is appealing his conviction. His appellate attorney will argue Judge Evelyn Wilson did not allow the jury to consider whether Miles acted in self defense after the initial break-in and assault of News Director Jon Janes.
Assistant District Attorney Veronica Dersch said it may take a year before the case is considered for appeal.
