Emporia (WIBW/KVOE) - A woman accused of trying to kill her newborn son is being held on $250,000 bond.
A Lyon County judge made that order and set a December 9th preliminary hearing date during a court appearance Tuesday for 24-year old Christina Devine.
She's charged with one count of attempted intentional first-degree murder for allegedly leaving her newborn son in an apartment dumpster last Friday.
An affidavit submitted by police says Devine told them she didn't know she was pregnant until a few weeks ago and that she had been raped and couldn't identify the baby's father. The affidavit says Devine told police she did it because she was scared of being a mother.
KVOE reports the baby is in protective custody. A child in need of caring hearing was set to be held Tuesday for the child.
