A three-year-old lawsuit over what was once a $1.4 million southwest Topeka mansion has been dismissed.
Contractor Randy Lilly filed the suit in October of 2010 on the property owned by Daniel and Peggy Bailey, located at 5037 SW Urish Road. Lilly claimed the Baileys refused to pay, citing numerous water leaks and other construction problems.
In June, the Kansas Board of Tax Appeals ruled the property is worth $565,000, far more than what the Baileys believed reasonable.
A 13 News examination of Shawnee County Court documents indicates the lawsuit has been removed from the active court docket. The dismissal was filed with prejudice, meaning it could be refiled at a future date.
The dismissal did not specify whether the parties had reached a tentative settlement in the suit.
