TOPEKA, Kan. (WIBW)-- The high court also heard arguments on whether gun shop owners can be held liable for selling a gun later used by a convicted felon.
Russell Graham used a shotgun his grandmother bought from a Baxter Springs Gun and Pawn Shop to kill himself and his eight-year-old son in 2003.
The shop's owners initially denied the sale to Graham.His wife filed a negligence case against the shop's owners,saying the grandmother was a so-called "straw purchaser." And alleging they concealed evidence from law enforcement.
A lower court dismissed the case,but the court of appeals reversed that decision in 2010.
