Jury Finds Hollister Guilty Of Capital Murder

ATCHISON, Kan. (WIBW) - Patricia Kimmi's family says their faith helped them believe justice would be served for their mother. That faith came to a head late Tuesday afternoon, when an Atchison County jury found Roger Hollister guilty of capital murder in Kimmi's death.

Kimmi disappeared from her home in rural Horton in November 2009. Portions of her remains weren't found until the following May.

The verdict follows a week of testimony in the case. Closing arguments were heard after lunch Tuesday and jurors didn't take long in reaching their verdict. The judge announced their decision just after 4pm, and took them about 3 hours.

Hollister's attorneys tried to cast doubt, saying Hollister was merely a pawn of Kimmi's ex-husband Eugene. Eugene Kimmi has not been charged in the case.

Family and friends of Kimmi said the moment was surreal. A chapter closed in the on-going investigation into her murder and although Tuesday’s verdict brought Kimmi's family a bit of relief, the pain of her death remains.

"I still miss my mom. She was always there for everything, everyday. There won't ever be a day that she's not missed,” said Kimmi’s daughter, Rita Boller.

Sentencing is set for April 4th. Prosecutors already have said they will not seek the death penalty, which means Hollister faces a sentence of life in prison without possibility of parole.

Prosecuting attorney, Jerry Kuckelman, said there are more suspects to be investigated in Patricia's death and he did not deny that Eugene Kimmi was one of them.

Hollister's time in court isn't over. He's set to stand trial March 11th on charges of attempted murder for a car accident which severely injured his wife, Rebecca. Rebecca testified for the prosecution in the murder trial.
