TOPEKA, Kan. (WIBW) - A convicted kidnapper will not be paid damages for an accidental shooting during his arrest.
Jurors returned their verdict Thursday morning, siding with the city of Topeka and Sgt. Guy Gardner in Jesse Dimmick's claim for $180,000. They began deliberations Wednesday afternoon.
Gardner's gun discharged while taking Dimmick into custody in September 2009. Dimmick was shot in the back.
Prosecutors say Dimmick stole a van to flee murder charges in Colorado, led police on a high-speed chase, then took Lindsay and Jared Rowley hostage in their Dover home.
Dimmick's appeal on his criminal convictions in the kidnapping case will be heard next Tuesday during a Kansas Court of Appeals session at Washburn University.
