Judge Sets Hearing On Move Of Murder Defendant Declared Insane

TOPEKA, Kan. (WIBW) - A Topeka man declared insane after he beat an elderly woman to death will remain at a Topeka care facility at least a little longer.

Shawnee County prosecutors are objecting to a Pawnee County judge's decision to release Hal Bates from Larned State Hospital to a Topeka nursing facility for mental health.

Bates was found not guilty by reason of insanity in the March 2001 beating death of 85-year-old Elizabeth Cowpertherwaite. She was found dead outside her townhome in the 2600 block of SW Arrowhead in Topeka. Bates was living at a group home in the same block.

During a docket appearance Thursday, a Shawnee County judge set an August 30th hearing on the issue of Bates' release. The Shawnee Co. DA's office tells 13 News Bates will remain at the Topeka facility in the meantime.
