TOPEKA, Kan. (WIBW) - Shawnee County will motion to dismiss a case filed by a former jail inmate.
Claybon John McGlory filed a petition for punitive damages against the Shawnee County Department of Corrections, Corrections Medical Department, Prison Health Services, Correctional Health Care to the Sheriff of Shawnee County and Shawnee County Commission.
McGlory wants $10 million, saying he was denied medical treatment for cancer while serving 30 days in jail. County commissioners acknowledged receipt of the lawsuit at their meeting Thursday.
Shawnee County Counselor Rich Eckert says McGlory does have a history of cancer, but says medical records for him did not indicate he needed further treatment.
McGlory has a court date on drug charges May 15th.
