TOPEKA, Kan. (WIBW) -- New details have emerged on the AMBER Alert issued for a missing Oklahoma infant on Thursday night. Authorities had said 5 month-old Olivia Smith was illegally taken from her grandmother's home in Cashion, Oklahoma, by 47 year-old Cindy Findley.

As it turns out, Findley says she had permission to take Olivia from Oklahoma to Texas.

Her husband, Sid Findley, said a family member falsely requested the AMBER Alert and made misleading statements in order to escalate a private family matter.

According to reports, when Findley and a friend were stopped in Texas, they showed paperwoth indicating they had permission to take Olivia to Texas.

However, that may not be enough to move the child from Oklahoma legally. Also, the women may have entered a home illegally when they took the little girl. Prosecutors are now looking into those issues.

Baby Olivia is safe and the entire incident is likely the result of a family dispute over the custody and care of the child.
