TOPEKA, Kan. (WIBW)-- A Topeka man will get a new sentencing hearing on his conviction for aggravated assault with a deadly weapon and other crimes.
The Kansas Supreme Court today overturned Shawnee County District Court and Kansas Court of Appeals rulings that gave Gerardo Urista an 18 year, 9 month sentence back in 2009.
He argued a plea agreement called for an 8 and a half year sentence. Urista, who was 17 at the time of the crime, said "the judge increased the sentence due to negative comments the prosecutor made at sentencing."
