Shawnee Co. Attorney Rich Eckert now has permission to file an accomidation proceeding against the owners of four properties near the proposed dual roundabouts east of 46th Street and Highway 75 if doing so becomes necessary.
The permission was given though Eckert says he has not reached thepoint of filing yet with any of the lands owners.
The county made the move because it wants to fast-track the process of acquiring the land since federal stimulus money will help pay for the roundabouts, according to Eckert.
He says all the lands sought amount to only portions of each of the properties and would not affect any extant srtructures
If an agreement cannot be reached, appraisers would determine the value of the land, at which point the county may seize it for public use. The property's owner may appeal to a jury if the amount tendered is unsatisfactory.
