Preliminary Hearing Set on Reduced Charge in Shooting

A Topeka man will stand trial in the shooting of a Clay Center woman, but on a lesser charge than prosecutors sought.

The Clay Center Dispatch reports a judge bound Tracey Hackney over on a charge of second degree attempted murder Friday. Hackney was charged with attempted first degree murder, but the paper says Judge Bill Malcolm ruled evidence of premeditation was lacking.

Hackney is accused in the December 4th shooting of Terry Buskirk in Clay Center. Buskirk suffered minor injuries. Authorities said at the time the shooting might have stemmed from an argument over money.

Hackney's arraignment is set for Wednesday, April 22.
