Hearing Set in Developer's Suit Against City

There's a new hearing set on a lawsuit filed by a Topeka developer against the city of Topeka.

Gene Jani filed the suit back in June of 2007, saying the city council acted illegally by failing to approve a commercial development and housing project at 3420 SW Fairlawn Rd.

Several neighbors filed a protest petition against Jani's Brainstorm Development Project, which was to be across the street from French Middle School.

Jani filed a suit for over two million dollars, and in September of 2008 the city asked judge Larry Hendricks to issue a summary judgment to settle the case...

Judge Hendricks has set April 27th as the date for arguing the summary judgment motion and set a trial date in the suit.
