Tiller's attorneys are trying to show that he's the victim of prosecutorial misconduct. They allege that Carter influenced Morrison to file charges against the doctor.
Tiller faces 19 misdemeanors, alleging he failed to get a second opinion for some late-term abortions from an independent physician. Morrison filed the charges in June 2007.
But Morrison was forced to resign in January after acknowledging his affair with Carter, a former subordinate. Carter later left Kansas for Arkansas.
