Friday's ruling followed a three-day hearing on the issue. At the
arraignment, there will be a formal reading of the child abuse charge and Patton will enter a plea.
On July 15, Riley County police responded to his Manhattan residence after receiving a 911 call about a child not breathing. Patton was arrested Sept. 19. The arrest warrant indicated Patton ``unlawfully and feloniously and intentionally shook'' the infant.
Patton was dismissed from the Kansas State team after the charge
was filed. His is free on bond.
