$3.6 Million Lawsuit Dropped Against Kite's Owner

RILEY COUNTY, Kan. (WIBW) -- A multi-million dollar lawsuit against a local business owner has been dismissed in Riley County District Court.

Farmers State Bank filed a lawsuit in July against William "Rusty" Wilson and his companies: Kite’s Bar and Grill, Inc.; Rusty’s Bargain Barn, Inc.; W.R. Wilson, Inc.; and Rusty’s of KC, Inc- all based in Manhattan. Wilson also owns Rusty's Last Chance Saloon in Aggieville and the Kite's restaurant in Junction City.

The bank was seeking more than $3.6 million in repayment for what they claimed were unpaid loans.

The 19 page lawsuit contained 10 different counts alleging a breach of contract and the bank sought foreclosure of Kite’s Bar and Grill and possession of other property and holdings.

On September 19, 2012, the lawsuit was dismissed with prejudice, meaning that it cannot be refiled and Wilson cannot be sued again for the same claims made in the suit.

Wilson told WIBW that both sides came to a mutual agreement.

"I am extremely happy with the dismissal and I am moving forward and looking or forward to many many years owning and operating Kites," he said.

Farmers State Bank had no comment on the lawsuit.
