Third Wittig Trial Likely to be Postponed

TOPEKA, Kan. (AP) _ A federal judge says she will likely have to delay the start of the third criminal trial of former Westar Energy Inc. CEO David Wittig.

Wittig and former chief strategy officer Douglas Lake are scheduled to go on trial Sept. 9 for charges of conspiracy and circumvention of internal controls.

U.S. District Judge Julie Robinson said Monday during a court hearing that she didn't expect the 10th U.S. Circuit Court of Appeals to decide whether to dismiss some of the charges until only days before the trial, at the earliest.

She also said her staff would need around 30 days after that decision to prepare a pool of potential jurors for the 10-week trial, currently scheduled to be held in Kansas City, Kan.
