A Topeka developer's lawsuit against the city is proceeding according to schedule despite his attorney's run-in with the law.
Gene Jani tells 13 News Bryan Smith will continue to represent him.
Jani is suing over the Topeka City Council denying a zoning change for Brainstorm Development's proposed development at SW 34th and Fairlawn. Smith is no longer part of the firm that filed the case following his arrest for public drunkenness earlier this month at the Memphis airport. That firm, now called Cavanaugh and Lemon, withdrew from Jani's case.
Jani's case is set for pretrial hearing July 23rd in Shawnee County District Court. The trial is set for September 2nd.
