Sheriff Expects Report Soon In TPD Officers' Deaths

TOPEKA, Kan. (WIBW) - Shawnee Co. Sheriff Herman Jones says he expects his office will have a report on the investigation into the fatal shootings of two Topeka Police Officers completed within a week.

The Sheriff's Office is leading the investigation into what happened Dec. 16, 2012 in the parking lot of the Dillon's store at Huntoon and Lane that ended with the shooting deaths of Corporal David Gogian and Officer Jeff Atherly. Topeka Police Chief Ron Miller asked the Sheriff's Office to do the investigation since TPD was directly involved.

Jones told 13 News Friday that the two people who were in the car with suspect David Tiscareno at the time of the shooting were both women. The officers were called to the parking lot to check on the vehicle because some sort of drug activity was suspected.

Authorities previously said the officers asked the people to get out of the vehicle and, as the other two occupants were exiting, Tiscareno got out from the rear driver's side seat and opened fire. Authorities said Tiscareno then got back into the car and drove off. The other two occupants were interviewed the night of the shooting.

Tiscareno was shot and killed early the next morning, following a standoff with law enforcement.

Jones told 13 News he expects a report on the investigation within the week. The District Attorney's office would review it for any possible charges.
