TOPEKA, Kan. (WIBW)-- Yet another delay in the sentencing of the last of 4 defendants in a 2010 murder on the Topeka West High School campus.

24 year-old Coty Newman is trying to withdraw a first degree murder plea, saying his attorney was ineffective.

Judge Evelyn Wilson agreed to appoint a new attorney as early as next week and set a December 31st hearing to decide if Newman will be allowed to withdraw his March 23rd guilty plea in the 2010 shooting death of Matthew Mitchell.

A reported alibi witness for Newman now faces a perjury charge.
