Qualls Retrial In Whiplash Bar Murder Case Rescheduled

TOPEKA, Kan. (WIBW) - A Topeka man's retrial for a fatal shooting outside an East Topeka bar is delayed.

Proceedings for James Qualls were to get underway March 3rd. However, this week a Shawnee County District Court judge granted a defense motion for a continuance. The defense requested pushing back the trial so they have more time to arrange for an expert witness and interview other witnesses.

The new date is June 23rd.

Qualls was convicted of second degree murder in the July 2008 shooting death of Joseph Beier outside the Whiplash Bar at SE 21st and California.

The Kansas Supreme Court ordered a new trial in the case. Justices agreed with Qualls' appeal that jurors should have been instructed on the lesser charge of voluntary manslaughter.
