TOPEKA, Kan. (WIBW) - A preliminary hearing for a Topeka firefighter has been delayed a second time, because the victim refused to appear in court Wednesday.

Claude Clark is charged with aggravated battery, aggravated intimidation of a witness, and two counts of aggravated assault..

Court records indicate that during Wednesday's proceedings, a "key" witness to the February incident failed to appear in court.

Records show the preliminary hearing will be set once the witness is brought before the court.
