Emporia (WIBW) - Emporia Police are pushing for attempted murder charges against the mother of a newborn found in a dumpster.
Investigators submitted an affidavit to Lyon County Attorney Marc Goodman which proposes a charge of first degree attempted murder against Christina Devine.
Goodman's office which charges, if any, to pursue.
The baby boy was found last Friday morning in the dumpster of an Emporia apartment complex. Medical staff estimated he had been born a half hour earlier.
According the affadavit, Devine told police she didn't realize she was pregnant until earlier this month and she took the baby to the dumpster after she woke up, saw "there was a lot of blood and her stomach was flat."
