TOPEKA. Kan. (WIBW) - The man who smashed his way in to WIBW-TV last May walked out of court Thursday morning after the judge denied his request for a new trial.
Ray Miles refused to swear an oath but told Judge Evelyn Wilson he would tell the truth.
Miles argued he should get a new trial because everyone lied at his trial last November and because the judge refused to let him fire his attorney.
However, Judge Wilson disagreed, ruling there were no grounds for a new trial.
Miles new defense attorney also asked that two convictions in Arkansas be excluded from Miles' criminal history because the prosecution did not prove they were Miles' crimes. When assistant district attorney Veronica Dersch produced documentation of the incidents, Miles told guards he wanted to leave the courtroom. He did not return for the rest of the hearing.
Judge Wilson then ruled both Arkansas convictions were valid. The decision means two more years could be added to his sentence.
Wilson also overruled Miles' attorney's ojbections and will allow camera coverage at his sentencing. It is set for April 24.
