Judge To Issue Decision In Kansas River Death Lawsuit
TOPEKA, Kan. (WIBW) - A lawsuit against the City of Topeka and the state filed by a man whose son drowned in the Kansas River will not go to trial.
Shawnee County District Judge Larry Hendricks said Tuesday he'll issue a decision in the case next week. He says it's in response to motions for summary judgment from the parties involved.
A jury trial was set to begin Monday in the lawsuit Jim Bryant filed in 2009. His 25-year-old son, Josh, and another man, 30-year-old Richard Heyroth, died in August 2007 when their canoe capsized at a low-water weir near Topeka's water treatment plant.
Bryant contended authorities failed to properly warn boaters of the approaching danger and didn't provide a route to carry boats around the weir.
