HOLTON, Kan. (WIBW) - A preliminary hearing is set for a Topeka man accused of attempted murder, kidnap and rape.

35-year-old Filip Rosario had a status hearing Monday in Jackson County court. During the appearance, his attorney withdrew a request to have Rosario evaluated for competency, saying he believes his client has stabilized.

Rosario was captured in December in Topeka. He faces nine felony counts. Authorities say he raped a Holton woman and brought her to Topeka, where she escaped and called authorities.

The hearing to determine whether there is enough evidence to bind him over for trial now is set to take place April 3rd.
