TOPEKA, Kan. (WIBW)- Shawnee County District Attorney Chad Taylor has filed a capital murder charge against 28 year old Dustin Leftwitch in the killing of Seaman High graduate Brenna Morgart.
The revised criminal complaint was given to Shawnee County District Court Judge Cheryl Kingfisher this morning.
District Attorney Chad taylor is attempting to stiffen charges against a man they say raped and killed 18 year old Brenna Morgart.
Leftwich previously faced counts of pre-meditated first degree murder and aggravated kidnapping. A count of rape also was also added today. Which was the basis for the capital murder charge.
If convicted, prosecutors could seek the death penalty... but haven't said yet whether they'll do so.
Brenna morgart, a homecoming queen and sunday school teacher graduated with honors from Seaman High School five days before her death.
She went out for a jog near her northwest Shawnee County home in May. Authorities say she was hit by a car and her body moved several miles to where it was found in a field.
Pre-meditated murder during rape is one of seven offenses when a capital murder charge is applicable.
A motions hearing in the case that was set for this morning was postponed until January 10th at 11 AM.
