Police: Murdered 8-Year Old Was Sexually Assaulted

TOPEKA, Kan. (WIBW) -- Topeka Police say an eight-year old girl who was found dead Tuesday at a southeast Topeka apartment complex was sexually assaulted.

Police were called to the 2400 block of SE Bellview around 5 am Tuesday. Family reported Ahliyah Irvin missing. About 45 minutes later, Topeka Police Chief Ron Miller said, Ahliyah was found dead in an apartment in the same complex.

Miller would not give details on how Ahliyah was killed or the condition of her body, but did call the crime "particularly heinous."

Police identified 28-year old Billy Davis as a person of interest a short time later. Around 10:15 am, police were notified that a suspicious person had tried to enter the Linn Elementary School building, 200 SE 40th St. Miller says the man made it into the foyer, but the doors into the main building were locked and staff did not let him in.

Linn Elementary closed after last school year, but now houses USD 501's Title 1 offices and gifted and restorative programs, so there were some students in the building. Miller said "one can only speculate what might have happened" had the man, believed to be Davis, made it into the main hallways, but, he said, thankfully, no one has to because the district was proactive in its security policies.

With the call, Miller says 50 officers from multiple law enforcement agencies set up a perimeter "so tight not even air could escape" in the area around the 4400 block of SE Truman. Davis was taken into custody at about 11:30 am. He was found hiding in a creek bed near I-470, about five blocks southeast of Blind Tiger.

Davis was booked into the Shawnee County Jail late Tuesday afternoon on charges of Aggravated Burglary, Aggravated Kidnapping, Rape and Felony First Degree Murder. Police confirm a sexual assault occurred during the incident.

Ahliyah's family had planned to hold a vigil for the girl 7 pm Tuesday at SE 35th and Bryant. A fund to assist with funeral expenses was still being arranged, but friends have organized a benefit car wash from 10 am to 1 pm Wednesday in the parking lot of the Burger King near 37th and S. Topeka Blvd.

Topeka Police said they were searching for a second individual they described as a person of interest. They did not identify the person, saying they did not want the person to leave the area.
