Arraignment Delayed For Men Charged With Murder At Topeka West HS

TOPEKA, Kan. (WIBW) -- The arraignments for two men charged with felony-first degree murder in the shooting death of 20-year-old Matthew Mitchell at Topeka West High School in late October were delayed on Thursday.

A judge is delaying 21-year-old Coty Newman's arraignment until January 3rd.

His defense attorney wanted time to review a complaint from prosecutors amending Newman's first-degree felony murder charge to premeditated first-degree murder.

The defense attorney for 19-year-old Austin Tabor made a request to see that same complaint, also amending Tabor's first-degree felony murder charge to premeditated first-degree murder. Tabor's arraignment has now been scheduled for December 30.

Samantha Hochard, age 20, is also charged with first-degree felony murder in Mitchell's death.

Prosecutors believe the trio used drugs to lure Mitchell to the Topeka West High School grounds to kill him.
