Morrison Files 'Friendly' Lawsuit Over Expanded Gambling Save Email Print

TOPEKA, Kan. (AP) _ Attorney General Paul Morrison has filed his long-awaited lawsuit over the state's new gambling law. But the goal is to have the Kansas Supreme Court declare the law constitutional.

The law authorizes casinos and slot machines at dog and horse tracks.

Morrison's lawsuit argues that it violates the constitution because the lottery won't truly own and operate the new gambling. That's required by an amendment approved by voters in 1986.

Morrison is essentially making the same arguments as some opponents when the law was drafted this spring.

Eleven other states have nontribal casinos but don't own the hotel-and-casino complexes allowed under Kansas law. Governor Sebelius asked Morrison to file the lawsuit, saying a ruling will bring certainty to the bill's constitutionality.
