Fate of Abortion Provider Rests with Former Foe
The fate of a high-profile abortion provider now rests with a judge who once was one of his most vocal opponents in the Legislature.

WICHITA, Kan. (AP) _ The fate of a high-profile abortion provider now rests with a judge who once was one of his most vocal opponents in the Legislature.
Sedgwick County District Judge Anthony Powell will decide whether a state law restricting late-term abortions is constitutional.
Dr. George Tiller's attorneys are challenging the law.
Attorney General Paul Morrison has charged the Wichita abortion provider with 19 misdemeanors. He alleges Tiller violated the law because he didn't get a second opinion from an independent doctor before performing late-term abortions in 2003.
Powell had an hour-long hearing Friday on the law's constitutionally, but he doesn't plan to rule until at least early next month.
