Topeka, KAN. (WIBW)--Two men injured in a shooting with off-duty Topeka police officers have filed more than $47 million in claims against the city.

A copy of the claims filed on behalf of Daniel and Devin Llamas and their significant others shows they allege negligence, conspiracy and emotional distress. The Llamas were involved in a confrontation March 18, 2008, which led to the shooting.

After a review, Police Chief Ron Miller said the four officers involved acted inappropriately, but did not violate policies.

Attorney Pedro Irigonegaray said he plans to file a civil lawsuit against the city before the anniversary of the shooting. He also made he can't believe Miller would choose to retain officers who engaged in such conduct.

"I think we deserve better," he said.

The City had a chance to handle this themselves and decided not too. The only way to make the Police Dept and the officers take responsibility is to take it to the next level. I agree that this has gone on long enough but the Police chief has given these people no choice. Pedro, you do what you have to do and give this family justice anyway you can.

what's the deal with the police dept these days. off duty police officers going to a scene after drinking most likely drunk too. guns drawn shooting these guys while drunk and off duty. and think they can just get away with it how dumb. and just days ago a pedestrian is hit by police officers at third and topeka a david spellman was hit. and try to get off of that and years ago a man was killed in his truck on lower silverlake road by topeka police officer. do they think they are above the law or what. topeka is going broke and the police want to write tickets for everything they can. a sad sad day for topeka and the folks living here just trying to find a job.
