Probation Controversy Continues Save Email Print

Controversy continues to surround Judge Matthew Dowd's decision to sentence two sex offenders to probation.

Orlando Paul Cisneros was convicted of raping a 14-year-old girl...he's out on probation, as is Federico Mendoza, who tried to meet young girls online.

Advocates are focusing on the decision, and the public is speaking out.

Nikki Delaney works for Cyberwatch -- a group that tries to catch sex offenders online.

She was stunned by the probation sentences for Cisneros, and the man she helped catch, Mendoza.

She says the public needs to act.

The community is well ahead of her.

Officials say sentencing guidelines are just that -- guidelines.

In the cisneros case -- Judge Dowd has said the defendant suffered with depression...and there was no long-term harm to the victim.

That doesn't mean his decision is final.

The family of the victim in the Cisneros case says they will appeal.

It makes no difference if the child "consented". We're talking about a child who's barely 14 years of age being raped and manipulated by a 38 year old man. The fact that she may have snuck out once to meet the offender does NOT explain or excuse Judge Dowd's decision. Yes, oral sex also falls under the sodomy charge(s)... how does that make it better? Cisneros, 38, repeatedly raped a very young child, barely 14. There is NO excuse for that and there's NO EXCUSE for Judge Dowd's actions in these cases. Either of them.

This judge is crazy. What is he thinking letting predators out there. A man raped a child, another trys to have sex with a CHILD. What is wrong with this guy. This is not justice. I think the penalties for sex offenders should be a changed. Jail/prison time should be mandatory. I hope this judge is removed very soon, because when these men do it again, I want someone else judging them.

as I was saying, sodomy includes oral copulation. "Aggrevated criminal sodomy" and "indecent liberties with a child" involve a victim who is under the age of 16 years and NOT MARRIED to the acting party. Additionally, "indecent liberties with a child" includes intercourse, fondling and even solicitation under the same circumstances. The law doesn't require the perpetrator be over a specific age for these crimes to have occured. Now when these acts are perpetrated by a 38 year old, it is abhorant. But, how many of the children in this community could be found guilty of the very same crimes?

It seems the general public needs further understanding of Kansas statutes, how these crimes are classified, and to consider that this 14 year old girl snuck out (of her own volition) to meet the offender at least once. Not that this excuses his behavior, but it might clarify for the lay person the circumstances surrounding Dowd's ruling. Terms like rape, sodomy and indecent liberties are highly charged, but surprisingly broad under Kansas law. For example, sodomy includes oral

This is sick. Judge Dowd should be removed immediately. Releasing both of those guys back into our community so they can do it again! Just unbelievable. Disgraceful. Sickening!! I feel terribly for the girl and her family. Dowd must GO. Any judge that is soft on child molestors needs to GO. People write to the judges. Call them! They need to hear from us.

Judges like Mr. Dowd, turning predatory rapists loose on our children, will surely provide justification for changing our sentencing guidelines into absolute mandatory minimum sentences, without exception, in cases of child rape. Very glad that Mr. Dowd will resign from the bench. If he's not off by January, tell your state legislators to impeach him.

I think the sex offender laws should be changed a little. Did you know that if you are outside and piss outside and someone sees you, you have to register as a sex offender for 10 years. It is considered lude and ludicious. I'm sorry I don't believe that someone who raped someone and someone who peed outside should be treated the same
