The Emporia City Commissioners passed the ban on smoking 3-2 Wednesday afternoon according to City Attorney, Blase Plummer. Of the two plans proposed the commission selected the comprehensive smoking ban. Beginning March 3, 2009 smoking will no longer be permitted in public areas or places of employment.
The ban prohibits smoking 10 feet from the main entrances of any public place but employees will be able to light up outside of any other entrance. Tobacco sales outlets are excluded from the ban.
One of the opponents of the ban is likely to start a petition for referrendum. Plummer says they will need around 770 signatures or 20% of those who voted in the last city election to place it on the April ballot.
