Allegations of misconduct are being made in the Shawnee County District Attorney's race.

Democrat Chad Taylor said Tuesday that filings in the Sedgwick County case against abortion provider George Tiller show Republican Eric Rucker and former Attorney General Phill Kline intentionally misled the court and state agencies while pursuing their "personal beliefs," not the law.

Rucker was Kline's top advisor in the AG's office.

“Shawnee County deserves a district attorney with the right focus and priorities, not someone lacking professional judgment and pursuing their own personal agenda," Taylor said in a statment. “Shawnee County cannot afford a district attorney who thinks he is above the law,” Taylor said. “As district attorney, I will both enforce and follow. Eric Rucker and Phill Kline showed a blatant disregard for the law in their reckless quest to obtain Kansas citizens’ private medical records."

Rucker says the document Taylor is citing was a motion made by a defense attorney. Rucker says it was reviewed, and he was never cited with any wrongdoing.

"In my 15 years as a criminal prosecutor I have seen hundreds of similar motions. This is simply what criminal defense attorneys do," Rucker said in a statement. "In my 27-year career as an attorney, I have never been found to have committed any act of professional misconduct. Two separate judges...reviewed the facts related to this criminal investigation and my limited involvment in the matter and neither has cited me for acts of professional misconduct."

Rucker defeated incumbent DA Robert Hecht in the August primary. Taylor defeated attorney Jerry Berger to advance to the November ballot.
